By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site. These Terms are governed by the laws of the State of Florida.

Licensee and Brokerage Information

All real estate activities described on or facilitated through this Site are performed by a licensed Florida real estate sales associate under the supervision of a licensed Florida real estate broker. Brokerage Relationship Disclosure — Florida Statute § 475.278

This is a required disclosure under Florida Statute § 475.278 (Brokerage Relationships in Real Estate Transactions).

2.1 No Brokerage Relationship Created by Website Use

Accessing this Site, browsing property information, or submitting a contact inquiry does not create a brokerage relationship between you and Austin Kimbler or Expert Realty, LLC. A brokerage relationship is established only through a separate written agreement signed by both parties, as required by Florida Statute § 475.278.

2.2 Types of Brokerage Relationships Available in Florida

Florida law recognizes three types of brokerage relationships:

Single Agent

The broker represents one party (buyer or seller) exclusively and owes that party fiduciary duties including loyalty, confidentiality, obedience, disclosure, full accounting, and skill and diligence. A single agent relationship may be converted to a transaction broker relationship with written consent. (Florida Statute § 475.2755)

Transaction Broker

The broker provides limited representation to a buyer, seller, or both in a real estate transaction and is not a fiduciary of either party. The broker assists with the transaction without representing the interests of either party to the detriment of the other. This is the default brokerage relationship in Florida unless otherwise agreed in writing. (Florida Statute § 475.278(1)(b))

No Brokerage Relationship

The broker works with a buyer or seller without representing either party. In this capacity, the broker owes limited duties: deal honestly and fairly, disclose all known facts that materially affect the value of residential real property, and account for all funds entrusted to the broker. (Florida Statute § 475.278(3))

2.3 Duties Owed to All Parties

Regardless of the type of brokerage relationship, Austin Kimbler and Expert Realty, LLC owe the following duties to all parties in a real estate transaction, pursuant to Florida Statute § 475.278(2)(a):

  • Deal honestly and fairly.
  • Disclose all known facts that materially affect the value of residential real property and are not readily observable.
  • Account for all funds entrusted to the licensee.
  • Use skill, care, and diligence in the transaction.
  • Present all offers and counteroffers in a timely manner, unless directed otherwise.
  • Disclose the existence of any conflicts of interest.

Fair Housing — Federal and Florida Law

Austin Kimbler and Expert Realty, LLC fully comply with all applicable fair housing laws. The following laws prohibit discrimination in housing:

Federal Fair Housing Act (42 U.S.C. §§ 3601–3619)

Prohibits discrimination based on: race, color, national origin, religion, sex (including gender identity and sexual orientation per HUD interpretation), disability, and familial status (having children under 18 in the household).

Florida Fair Housing Act (Florida Statute Chapter 760, Part II)

Mirrors and supplements federal protections. Florida law also prohibits discrimination based on age (in non-senior housing contexts) under the Florida Human Rights Act (Florida Statute § 760.23).

NAR Code of Ethics — Article 10

REALTORS® shall not deny equal professional services to any person for reasons of race, color, religion, sex, disability, familial status, national origin, sexual orientation, or gender identity. Expert Realty, LLC and its affiliated licensees adhere to the National Association of REALTORS® Code of Ethics and Standards of Practice.

Steering Prohibition: We do not engage in steering, blockbusting, or any practice that directs, influences, or discourages a buyer or renter from or toward any neighborhood, community, or housing based on any protected characteristic. If you believe you have experienced discriminatory treatment, you may file a complaint with HUD at hud.gov/fairhousing or the Florida Commission on Human Relations (FCHR) at fchr.state.fl.us.

MLS and Listing Data Disclaimer

4.1 Florida Keys MLS Data

Property listings and market data displayed on this Site may be derived from the Florida Keys Board of Realtors Multiple Listing Service (MLS). All listing data is deemed reliable but is not guaranteed. Properties are subject to prior sale, change, or withdrawal without notice. Neither Austin Kimbler nor Expert Realty, LLC shall be responsible for any typographical errors, misinformation, misprints, or inaccuracies in MLS data.

4.2 IDX Data Usage

Where Internet Data Exchange (IDX) data is displayed on this Site, such data is the copyrighted property of the Florida Keys Board of Realtors and its participating MLS members. Unauthorized use, reproduction, or distribution of IDX data is prohibited.

4.3 Listing Accuracy

Property descriptions, square footage, lot sizes, and other details are sourced from public records and/or the MLS and should be independently verified. Buyers and sellers are encouraged to conduct their own due diligence and consult qualified professionals, including licensed appraisers, inspectors, and attorneys, before making real estate decisions.

4.4 No Appraisals or CMAs as Formal Valuations

Any Comparative Market Analysis (CMA), price opinion, or market information provided by Austin Kimbler is not an appraisal and should not be relied upon as such. Only a licensed Florida-certified appraiser may perform an appraisal under Florida Statute Chapter 475, Part II. A CMA is an agent’s professional opinion of market value for listing and negotiation purposes only.

RESPA Disclosure — Real Estate Settlement Procedures Act

The Real Estate Settlement Procedures Act (RESPA, 12 U.S.C. § 2607) prohibits real estate licensees from receiving or paying kickbacks or referral fees in connection with federally related mortgage transactions.

Austin Kimbler may, in the course of serving clients, refer them to mortgage lenders, title insurance companies, home inspectors, attorneys, and other settlement service providers. Unless a separate written Affiliated Business Arrangement (AfBA) disclosure has been provided to you, Austin Kimbler does not have any ownership interest in or receive compensation from such third-party service providers for referrals. Any referral arrangement that constitutes a financial relationship will be disclosed in writing prior to the referral, as required by 12 C.F.R. § 1024.15.

Clients are under no obligation to use any third-party service provider recommended by Austin Kimbler. The use of a recommended provider does not affect the availability or terms of any real estate service.

Florida Real Estate Regulatory Compliance

12.1 Florida Real Estate Commission (FREC)

Austin Kimbler is licensed by and subject to regulation by the Florida Real Estate Commission (FREC), a division of the Florida Department of Business and Professional Regulation (DBPR). FREC regulates real estate licensees under Florida Statute Chapter 475 and FREC Rule Chapter 61J2, Florida Administrative Code.

12.2 Florida Realtors® / Key West Association of Realtors

Expert Realty, LLC and its affiliated licensees are members of the Florida Realtors® and the Key West Association of REALTORS®, and are bound by the National Association of REALTORS® Code of Ethics and Standards of Practice. REALTOR® is a registered trademark of the National Association of REALTORS®.

12.3 Complaints and Disciplinary Actions

Complaints against a Florida real estate licensee may be filed with FREC/DBPR at myfloridalicense.com or by calling 850-487-1395. Complaints may also be submitted to the Florida Realtors® Professional Standards Committee or the Key West Association of REALTORS®.

Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of this Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Monroe County, Florida. You consent to personal jurisdiction in Monroe County, Florida.

Florida Statute § 475.278 and the rules of the Florida Real Estate Commission shall govern any dispute arising from a real estate brokerage relationship with Austin Kimbler or Expert Realty, LLC.

Modifications to These Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting to the Site with an updated effective date. Your continued use of the Site after any modification constitutes your acceptance of the updated Terms. Material changes will be reflected in the “Last Updated” date above.

Severability and Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable under applicable law, that provision shall be severed from these Terms without affecting the enforceability of any remaining provisions. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Austin Kimbler / Expert Realty, LLC with respect to your use of this Site.
